These Terms and Conditions ("Terms") govern your access to and use of the website located at vendibean.com (the "Site") and VendiBean's office coffee and vending machine products and services (collectively, the "Services"), offered by VendiBean ("VendiBean," "we," "us," or "our").
By accessing the Site, purchasing a product from one of our vending machines, or entering into a service agreement with us, you ("you," "Customer," or "User") agree to be bound by these Terms. If you are entering into these Terms on behalf of a company, you represent that you have authority to bind that company.
VendiBean provides office coffee, pantry, and automated vending machine solutions to businesses ("Clients") for use by Clients' employees, guests, and customers ("End Users").

These services are sold or provided under a separate service agreement between VendiBean and the Client.
These Terms govern general use of the Site and vending machine purchases. They do not replace the specific commercial terms of any signed service agreement between VendiBean and a Client. If there is a conflict, the signed service agreement controls.
You agree to use the Site only for lawful purposes and in accordance with these Terms.

End Users may purchase products from VendiBean vending machines using a credit card, debit card, or supported mobile payment method.
All payments are processed through Stripe, Inc. ("Stripe"). By making a purchase, you also agree to Stripe's Terms of Service.
VendiBean does not store your full payment card details.
Product availability, pricing, and machine functionality may vary by location and are subject to change without notice.
If a machine malfunctions or fails to dispense a paid-for product, please refer to Section 4 (Refund Policy).
If a VendiBean vending machine charges you but fails to dispense your product, or you otherwise believe you are owed a refund, you may:
Our team will respond within 48 hours to provide a refund and a free product code.
Business Clients receiving office coffee or vending services from VendiBean do so under a separate service agreement, order form, or invoice that establishes pricing, equipment, contract terms, and payment terms.
If there is any conflict between these Terms and a signed service agreement, the service agreement controls for that Client relationship.
The Site and all of its content, including text, graphics, logos, and the VendiBean name and trademarks, are owned by VendiBean or its licensors and are protected by applicable intellectual property laws.
You may not use, reproduce, or distribute any Site content or VendiBean trademarks without our prior written consent, except as necessary to use the Site for its intended purpose.
The Site and our payment processes rely on third-party services, including Stripe.
We are not responsible for the acts, omissions, or availability of third-party service providers. Your use of those services is subject to their own terms and privacy policies.
THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SITE OR ANY VENDING MACHINE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE FULLEST EXTENT PERMITTED BY LAW, VENDIBEAN AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO VENDIBEAN FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM DURING THE SIX (6) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless VendiBean from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of:
We may suspend or terminate your access to the Site at any time, with or without notice, if we believe your conduct violates these Terms or is harmful to other users, VendiBean, or third parties.
Termination of Site access does not affect the terms of any separate signed service agreement, which will continue to be governed by its own termination provisions.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles.
Any dispute arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in San Diego County, California.
You consent to the personal jurisdiction of those courts.
We may update these Terms from time to time.
Any revised Terms will be posted on this page with an updated Effective Date.
Your continued use of the Site or Services after revised Terms become effective constitutes your acceptance of those changes.
